TERMS AND CONDITIONS OF SALES

Terms and Conditions will apply when you access, purchase and use our eCourse & eTest OR eTest Only (herein after called “Service). If you are unable to accept these Terms and Conditions, please do not click on the “Accept” button that appears at the end of the Registration Page. Before proceeding to purchase and use the Service(s), please read these terms and conditions carefully:

1.      Register Administrator and/or Student(s)/User(s) Account(herein after called “account”)

1.1.    Administrator Account

Prior to purchasing and using the Service(s), you must provide your registration details and Data^ for the Service(s)

by completing the online registration process. We will notify you of our acceptance of your registration by email message and/or on screen on the web page. These Terms and Conditions apply on every occasion that you use the Service(s). We may decline acceptance of your application at our discretion.

1.2.    Student/User Account

Upon successful of payment, you can register yourself or your company employees to use the Service(s) purchased by creating individual Student/User Account(s). Student/User’s details and Data are required in completing the registration process. You are solely responsible for the Student/User’s details and Data that you have provided and you acknowledge and agree that you have received the consent of every Student/User to provide and disclose his/her details and Data for the purpose of registering the Account for her/him to use the Service(s) purchased.

1.3.    Upon acceptance of your registration, you will be allocated a personalised account for the purchase and/or use of the Service(s). You are responsible for the use of the Service(s) under your Account, including without limitation, the security of your Account and its associated passwords and PIN numbers.

1.4.    When you register an account with Simplicity Focus Consultants, you would have been deemed to opt-in and agree to us contacting you via email , SMS and/or Direct Call to attend to your enquiry and dispute, if any or keeping you updated on our

a)   relevant product information.

b)   latest promotions and marketing campaigns.

c)   services and information offered through our website.

2.      Security of Administrator and Student/User Account

2.1.    You are solely responsible for the security and secrecy of your login identification, password(s) or PIN given to or chosen by you. You must ensure that these are not revealed to any third party. You are solely responsible for all activities that occur under your login identification, password(s), PIN and/or your Account.

2.2.    If you discover or suspect any unauthorised use or disclosure of your login identification, password(s) and/or PIN or that your Account security has been compromised, you must immediately:

a)   inform us; and

b)   change your password(s) and/or PIN.

2.3.    You are advised to log out of the account every time you leave your seat.

2.4.    You are advised to change your password(s), PIN or any other security identification regularly to protect your own security.

2.5.    The security of your Account is your own responsibility. We cannot guarantee the safety and security of any transmission.
 

 

3.      Payment

3.1   Paypal (which is the 3rd party) will provide a payment gateway for the Service(s) that you order and purchase. Paypal is not authorised to act on behalf of Simplicity Focus Consultants or its affiliates with regards to any other transaction or service.

3.2   Paypal will require your bank details in order to effect the payment. Simplicity Focus Consultants will not access or collect your bank details.

3.3   By registering and/or using the Paypal payment gateway, you acknowledge and agree that this payment service is provided by a third party provider. Any information and Data that you provide may be disclosed to this third party provider for the provision of the Service(s). Paypal use of your information will be subjected to Paypal’s Privacy Policy available at https://www.paypal.com/sg/webapps/mpp/ua/privacy-full.

3.4   You must not knowingly order the service(s) when there are insufficient funds in your bank account or insufficient credit on your credit or debit card to allow Paypal to collect payment successfully on behalf of Simplicity Focus Consultants.

3.5   Where an order to purchase the service(s) through Paypal has been placed and accepted, you will not be able to cancel that order through Paypal.

3.6   If we have already supplied the service(s) that you purchase before we receive notification of the failure of the payment, we will attempt to remove the service(s) from your account. If we are unable to remove the service(s) from your account because you have used or started to use it, then we reserve the right to collect cash or cheque from you.

 

4.      Validity period of Service(s) purchased

4.1     The validity period of all the services purchased is 12 months.

4.2     If the student/user has started to use the service, the validity will be 60 days from the day started.

4.3     No refund will be made if the student/user do not use the services purchased.

 

 

5.      Provision of Information and Data

5.1.    You agree that all information that you provide to us and Paypal to access and use the Service(s), including but not limited to your Data will be complete and accurate in all respects and you acknowledge that we and Paypal are wholly reliant on the accuracy of the Data you provide and will rely on it in the provision of the Service(s) to you. If we have reasonable grounds to suspect that your Data is untrue, inaccurate, not current or incomplete, we have the right to suspend, terminate, or refuse your current or future use of the Service(s).

5.2.    You can review the personal information you provided to us and make any desired changes to such information, or to the settings for your Account, at any time by logging in to your Account at www.simplicityfocus.com and changing your preferences. You can also close your Account by contacting enquiry.sg@simplicityfocus.com.  If you close your Account, your personally identifiable information will not be used by us for any further purposes, nor sold or shared with unrelated third parties, except as necessary to prevent fraud and assist law enforcement, or as required by law.

5.3.    You agree to update us immediately with any changes to the information you give to us during the registration process of Administrator and Student/User  including any changes to your Account details.

 

 

6.      Our Legal Rights

6.1     We reserve the right to refuse, change or remove login identification, password(s) or PIN which we deem inappropriate or offensive.

6.2     We can suspend the Service(s) you purchase or terminate this Agreement (or both) immediately if:
(a) you breach this Agreement;
(b) we believe that the Service(s) is being used in breach of your obligations herein;
(c) we determine that your Account is inactive for 5 years;
(d) bankruptcy or insolvency proceedings are brought against you, or an arrangement with creditors is made, or a receiver or administrator is appointed over any of your assets, or you go into liquidation;
(e) one or more than one payment resulting from your order to purchase our service(s) cannot be collected successfully by Paypal on behalf of Simplicity Focus Consultants;
(f) payment(s) collected successfully by Paypal on behalf of Simplicity Focus Consultants from your order of  the service(s) are subsequently disputed by you or your card issuer or your bank and the monies for the aforementioned payment are returned to you or your card issuer or your bank;
(g) we receive an advice from your bank that your payment details are no longer valid;

6.2     We may seek to recover any outstanding payments or payments that have failed collection for which you will remain liable.

 

 

7.      Liability
We make no warranty:

(a) that the Service(s) will not cause any harm to your system or Content;
(b) as to the accuracy, reliability or quality of any Content obtained through the Service(s) or that defects in any Software will be corrected; and
(c) that the Service(s) and access to them are error free and uninterrupted or available at all times.

 

 

8.      Changes and Updating

We may from time to time change any of these Terms & Conditions and/or such other terms and conditions agreed or accepted by you, including, without limitation, our price plans, charges and payment terms. We may also from time to time withdraw, suspend, or change any of the Services. We endeavour, where reasonably practicable, to give you reasonable advance notice of such changes. We will notify you of such changes through written notice, electronic mail, our bill, our website or such other form as we may deem appropriate. You agree that the display of the revised Terms & Conditions on our website will constitute notice of the changes. Your continued use of the Service(s) will constitute acceptance of the changes.
